No notice removals suspended

UK Border Agency policy was that 72 hours notice of removal must normally be given, this is suspended pending legal challenge starting on 15 June 2010.

This policy was subject of a damning judgement by the High Court when two children were taken from foster care by the UKBA without warning for same day removal. The following were the exceptions:

•medically documented cases
•certain cases involving children
•cases involving the best interest of others
•cases required to maintain order in removal centres
•consents to early removal

But notice must now be given.
