Under the Human Rights Act 1998, any decision regarding an individual’s entitlement to enter or remain in the UK has to be compatible with rights set out in the European Convention for the Protection of Human Rights (ECHR). In addition, anyone whose application for permission to enter or to remain in the UK is refused may be able to appeal against that refusal on the basis that the decision breaches his or her human rights.
