Eligibility for family members living inside the UK (after Brexit)

Family members of eligible EU, EEA, or Swiss citizens can apply for the EU Settlement Scheme if they meet certain criteria. Family members include:

To be eligible, family members of EU, EEA, or Swiss citizens must be living in the UK before December 31, 2020 and continue to live in the UK with their EU, EEA, or Swiss family member, who also applied for the EU Settlement Scheme.

If your application is approved, you will receive either settled or pre-settled status, depending on the length of your continuous residence in the UK. Remember to update your details if your personal circumstances change and apply for settled status after completing five years of continuous residence in the UK (if you initially receive pre-settled status).

Eligibility and application for family members living outside the UK (after Brexit)

Family members of EU, EEA, or Swiss citizens who are living outside the UK may still be eligible to apply for the EU Settlement Scheme, provided they meet certain requirements. These family members include spouses or civil partners, unmarried partners, dependent children or grandchildren, and dependent parents or grandparents.

To be eligible to apply for the EU Settlement Scheme from outside the UK, the family member must (aside from children), evidence they have been in a relationship with the EU, EEA, or Swiss citizen before December 31, 2020, and the relationship must still exist. The family member must also be joining or accompanying the EU, EEA, or Swiss citizen to the UK.

If the family member is an EU national and they are eligible, they should apply for EU settled status or pre settled status to enter the UK. If this is approved, they can travel to the UK to join or accompany their EU, EEA, or Swiss family member.

If the family member is a non-EU national, and they are eligible, they should apply for an EU Settlement Scheme Family Permit to enter the UK. This permit allows them to come to the UK to join or accompany their EU, EEA, or Swiss family member. Once they arrive in the UK, they can apply for pre-settled or settled status under the EU Settlement Scheme, depending on their length of continuous residence in the UK.
